A guiding principle of our firm's representation of our clients in tax matters is made clear in a famous quote by Judge Learned Hand in Gregory v. Helvering, 69 F.2d 809, 810 (2d Cir. 1934), aff'd, 293 U.S. 465, 55 S.Ct. 266, 79 L.Ed. 596 (1935) which states in part as follows:

"Anyone may arrange his affairs so that his taxes shall be as low as possible; he is not bound to choose that pattern which best pays the Treasury. There is not even a patriotic duty to increase one's taxes. Over and over again the Courts have said that there is nothing sinister in so arranging affairs as to keep taxes as low as possible. Everyone does it, rich and poor alike and all do right, for nobody owes any public duty to pay more than the law demands."

Although the payment of taxes is vital to our country and a patriotic duty of each citizen, all too often our tax laws are designed unfairly or penalize those who have worked hard to provide food for their families or create jobs through their ingenuity and hard work. In many cases faithful taxpayers pay more than they are required to simply due to a lack of knowledge of our tax laws (which is understandable given their complexity and ever changing rules). In some cases a "reward" for this hard work and attempt to comply with the complex tax laws is an IRS tax audit.
